1. WHY YOU SHOULD READ THIS TERMS AND CONDITIONS

1.1 It is important that you read and understand this Terms and Conditions before you start to access and use of the Service. The Terms and Conditions tell you who we are, how we will provide the Service to you, how this Terms and Conditions may be changed or ended, what to do if there is a problem and other important information.

1.2 The Terms & Conditions govern the use of website (“Website”) which enable you to access electronically and use of the service (“Service”).

1.3 In addition to the Terms and Conditions the following documents, also apply to your use of the Service:
a) Privacy Policy, which sets our terms on which we process any personal data we collect about you, or that you provide to us. By using the Service, you consent to such processing and you promise all data provided by you is true, accurate, complete, up-to-date and not misleading.
b) Cookie Policy, which sets out information about the “cookies” on our website.

1.4 By accessing the website and/or using the Service, you acknowledge to have read, understood and agree to be bound by the terms of the Terms and Conditions.

2. GLOSSARY

In this Terms and Conditions that below terms shall have the following meaning(s):
2.1 “Applicable Laws” means the laws, regulations, policies, guidelines, rules and requirements in relevant jurisdiction governing Easy Pay Transfers Sdn. Bhd. and/or the Customer, including and without limit to Anti-Money Laundering and Counter Financing of Terrorism Act 2001, Money Services Business Act 2011, Personal Data Protection Act 2010 and shall include other requirements that Easy Pay Transfers Sdn. Bhd. specifies from time to time.

2.2 “Authorized Person” means an authorized representative of the Customer. The Authorized Person can be:
a) a User from Single Control function of the Customer.
b) Two (2) Users from Dual Control function of the Customer. One User is a Maker or other User is an Authorizer.

2.3 “Authorizer” means an authorized representative of the Customer who authorize payment orders and make transaction via FPX on behalf of the Customer.

2.4 “Business Day” means the days on which the banks in Malaysia and Beneficiary Country are open for business and is subject to FPX services availability.

2.5 “Beneficiary” means the company who will receives the money transfer according to the Customer’s instruction.

2.6 “Beneficiary Account” means the bank account of the `Beneficiary authorized by the Customer for the purpose of money transfer payout..

2.7 “Beneficiary Country” means the country of the Beneficiary where the crediting of the Beneficiary’s account is to be made.

2.8 “Beneficiary Currency” means the type of currency in which the Beneficiary Country payout is to be made.

2.9 “Compliance Officer” means the staff at Easy Pay Transfers who is responsible for ensuring that the Service is in compliance with the Applicable Laws;

2.10 “Content” means all information or contents on the Website including texts, graphics, designs, layouts, web interface, images, videos, sound recordings, documents, databases and other materials.

2.11 “Customer” means the Company / Sole-Proprietorship / Partnership / Association / Club / Society whose registration has completed, accepted, approved and registered with Easy Pay Transfers Sdn. Bhd..

2.12 “Dual Control” means the Customer has subscribed for Dual Control function which allows appointment of two Users as a Maker and an Authorizer to complete a transaction. The Dual Control function is only available for private and public limited companies and Association/Club/Society.

2.13 “Force Majeure Event” means any of the circumstances referred to in clause 9.7

2.14 “FPX” refers to Financing Processing Exchange, a national online payment gateway which was jointly developed by financial institutions and is owned by MEPS (Malaysian Electronic Payment System).

2.15 “Loss” incudes loss, damage, claim, costs, subscription fees, charges, damages and/or expenses of whatsoever nature without limitation arising from contract, tort, equity or any other principles of law or legal theory (including any loss of profits, loss of savings, loss of data, loss of opportunity, loss of goodwill, special, incidental, punitive or exemplary losses and consequential damages) and howsoever arising whether direct, indirect, joint, several, actual, contingent or otherwise (including legal fees on a full indemnity basis), and includes without imitation claims made by third parties and claims for defamation, infringement of intellectual property rights, death, bodily injury, wrongful use of computers and unauthorized or illegal access to computers (including but not limited to hacking), property damage or pecuniary losses howsoever arising.

2.16 “Malicious Code” includes computer viruses, Trojans, software locks, dropdead devices, malicious logic or trap door, worms, time bombs, corrupted files or other computer program routines that are intended to delete, disable, deactiviate, damage, detrimentally interfere with, surreptitiously intercept or expropriate any systems, data, personal information or property of another

2.17 “Maker” means an authorized representative of the Customer who administer or create payment orders on behalf of the Customer.

2.18 “Payment Order” means every transaction or money transfer initiated by the Customer using the Service.

2.19 “Service Fee” means the charges and fees that we charge to you for the Service, as applicable, in accordance with the price list published on the Website or the prices or rates that we communicate to you before we issue a confirmation

2.20 “Services” refers to all products and services including online money transfer services offered by Easy Pay Transfers Sdn. Bhd.

2.21 “Single Control” means the Customer has subscribed for a control function which allows one representative of the Customer to create and authorize the Payment Order.

2.22 “User” means any person who access the Website and use its Services on behalf of the Customer and Users means any two or more of them.

2.23 “Taxes” means any tax, levy, duty, charge, deduction and withholding (without limitation goods and service tax (GST), if applicable), however it is described as that is imposed under the Applicable Laws by the Taxation Authority with any related interest, penalty, fine or other charges.

2.24 “Website” means the designated website: www.Easy Pay Transfers.com operated by Easy Pay Transfers Sdn. Bhd. to provide Services.

3. ABOUT US

3.1 Our Company Information. Easy Pay Transfers Sdn. Bhd. is a company incorporated under the Companies Act 2016 of Malaysia with our company registration number is 1207100-T (“Easy Pay”,“us”,“we”).

3.2 Our MSB License. We are a Money Service Business (“MSB”) company licensed with the License Approval number 00203.

3.3 Our Website. The website is www.EasyPayTransfers.com and the services are operated, administered, maintained and developed by Easy Pay.

3.4 Our Registered office. Our registered office is at Unit 13A01, Level 13A,Tropicana Gardens Office Tower, No. 2A, Persiaran Surian Tropicana Indah, 47810 Petaling Jaya, Selangor Darul Ehsan, Malaysia.

4. ELIGIBILITY

4.1 Authorised Person/User must be 18 years old and above. The Authorized Person and/or User must be an individual who is at least 18 years old and above to use our Services.

4.2 Your use of the Easy Pay Transfers account and its Service must not violate the Applicable Laws. You commit to us that your registering of Easy Pay Transfers account does not violate any Applicable Laws applicable to you. You shall be responsible for any consequences of your breach of the Applicable Laws and shall indemnify us for any losses or damages that may be suffered by us as a result thereof. .

5. GETTING STARTED

5.1 Sign Up Easy Pay Transfers Account. To start using our Services, you must first Sign Up for an Easy Pay Transfers Account and provide your details.

5.2 One account per entity. You are only allowed to open one (1) Easy Pay Transfers account for one (1) company. Easy Pay Transfers may reject duplicate Easy Pay Transfers accounts for the same or different company. If duplicated accounts are detected, Easy Pay Transfers has the right to close or merge duplicated accounts at its sole discretion.

6. GETTING TO KNOW YOU

6.1 Verification Call to Your Sign up Account. We shall perform a call verification with you after you have sign up for an account. We are required by Applicable Law to carry out necessary customer due diligence, security and phone call verification in order to provide any Services to you. Easy Pay reserves the right at its sole discretion, at any time, to prevent, stop, withdraw or reject the sign up application of any Users without providing any reason whatsoever.

6.2 Welcome Email. Upon successful call verification, Easy Pay shall send an email link to invite you to complete your Customer registration with Easy Pay Transfers.

6.3 Customer registration. Upon Customer registration, you shall provide additional information such as:
a) Company details
b) Authorized Person personal details
c) Required documentations in a format acceptable to us.

6.4 All required documents submitted must be Certified True Copy. All copies of the required documents must be attested as true copies of the original. All documents including copies of MyKad ID, Letter of Authorization and company forms shall be certified by designated or authorized signatories as follows:
a) Government Official
b) Advocates and Solicitors
c) Notary Public
d) Auditor
e) Embassy, High Commission or Consulate Officials holding administration and professional posts
f) Council Justice of the Peace

Please note that every single page of the documents submitted should be certified. It is important to notify your respective designated or authorized signatories that we will perform a call verification to ensure validity and authenticity of the documents.

6.5 Customer Due Diligence. You agree that we may make, directly or through any third party, any inquiries we consider necessary to validate the information you provided to us. You also agree to comply with any request from us for further information and provide us more information satisfactory to our Compliance Officer.

7. USER ACCESS RIGHTS & RESPONSIBILITIES

7.1 Information must be accurate. All information and documents provided by you must be true, accurate, complete, up-to-date and not misleading to facilitate approval and registration.

7.2 Inform Easy Pay on Corporate Particulars Changes. Customer is required to notify Easy Pay of any changes to the corporate particulars such as the shareholding and directorship structure and/or business activities and such other information as required by Easy Pay, in email and also producing original identification documents for verification purpose.

7.3 Easy Pay shall be indemnified for wrong information, Customer undertakes to indemnify Easy Pay, its employees, directors, officers, sales representatives, affiliates, subsidiaries and agents for any Loss suffered by Easy Pay arising from the Customer providing untrue, inaccurate, out-of-date, incomplete or misleading information or particulars.

7.4 Customer is responsible on Authorized Person. Customer is responsible to ensure that its Authorized Person shall take all such measures and steps as may be necessary (including but not limited to changing password from time to time) to protect Customer’s password and to prevent unauthorized use of User’s account or disclosure of the User’s password.

7.5 Customer is responsible to maintain secrecy and confidentiality. The Customer acknowledges that it is the Authorized Person’s sole and absolute responsibility to maintain secrecy and confidentiality of the Customer’s password and the Authorized Person shall be fully and absolutely liable for all transactions and activities that occur under the Customer’s username and password including unauthorized use and misuse.

7.6 Contact us if you suspect your account has been compromised. The Customer shall notify us in writing, if the Customer becomes aware of or reasonably believes that there is any unauthorized use of the Customer’s account or any other breach of security, and to co-operate with Easy Pay in all such investigation. This shall include:
a) Unauthorized usage of username and password
b) Receipt by Customer of any transaction confirmation
c) Fund transfer or such activities that Customer did not authorize
d) Any inaccurate information in Customer’s current transaction or transaction history

7.7 Customer is responsible for third part access to website. Customer shall be responsible and liable for any third party gaining access to the Website through the use of the Customer’s username and password, and in such event, the Customer shall hold Easy Pay, its employees, directors, officers, sales representatives, affiliates, subsidiaries and agents harmless against any Loss arising from any such authorized access. Any transaction and/or activity arising from the usage of username and password will be deemed the Customer’s transaction and/or activities, and Easy Pay is under no obligation whatsoever to verify authenticity of such transactions and/or activity.

7.8 Customer is responsible to log out. Customer is responsible to log out after each session of accessing the website.

7.9 Customer acknowledgement and agreement on funds transfers. Customer acknowledges and agrees that:
a) Unless there are sufficient funds deposited with Easy Pay in advance for the amount requested to be remitted by the Customer inclusive of the service charge and taxes, Easy Pay comes under no obligation whatsoever to act on the Customer payout instruction.
b) Easy Pay may restrict, decline or refuse Customer’s request for carrying out transaction at any time at Easy Pay’s sole discretion without assigning any reasons thereto
c) The Website may be accessible outside of Malaysia and Easy Pay accepts no liability whatsoever arising from any non-compliance with the laws of any country other than Malaysia for the use of the Services.
d) The Customer must specify the source of remittance and the purpose of remittance provided in the website for every transaction made.

7.10 Customer obligation to provide Proof of Payment. Customer is required to submit supporting documents in support of the Customer’s instruction for goods or services payments. The proof of payment documents can be Sales Contract, Purchase Order or Invoice or such other document as may be acceptable to Easy Pay.

7.11 Customer obligation to provide Proof of Delivery. We may request for supporting document(s) in support of the traceability of authenticity of Customer’s payments on goods or services. The proof of delivery documents can be Bill of lading, Custom Declaration or Delivery Order.

7.12 Supporting Documents can be submitted on website or email to us. The supporting documents can be submitted electronically to Easy Pay Transfers website or email to us directly. The Customer warrants that the information provided in these supporting document(s) shall be correct, complete and accurate.

7.13 Customer responsibility on Beneficiary information. Easy Pay Transfers relies on the registration information and the payment information provided by the Customer. Any errors in the information provided by the Customer including misidentification of Beneficiary, incorrect account holder’s names, Beneficiary Currency and Beneficiary Account numbers shall be the Customer’s sole responsibility and risk. The Customer undertakes to hold Easy Pay harmless from all losses and damages arising from any Easy Pay’s act or omission in reliance upon any such mistaken information.

7.14 Customer acknowledgement remittance payout duration. The Customer acknowledges that the duration for remittance payout delivery to the beneficiary shall be as stipulated in the Website.

7.15 Customer must maintain an Internet Banking Facility. The Customer acknowledges that it must maintain an internet banking facilities account with FPX participating bank(s) in Malaysia for the use of the Services.

7.16 FPX is a separate entity. FPX is a separate legal entity and use of Services is subject to terms, requirements and restrictions imposed by FPX and charges FPX imposes on the Customer. The Customer shall ascertain and update itself of such application terms and conditions. Easy Pay is neither liable not responsible for any Loss incurred or suffered by the Customer or any other person arising from the Customer’s utilization of the FPX services.

7.17 Customer is subject to transactions limit. Easy Pay reserves sole and absolute discretion to determine and impose limits for the transactions performed through the Website whether in amount, frequency or otherwise in accordance to the Applicable Laws and Easy Pay reserves absolute right to vary such limitations subject to requirements/amendments to the Applicable Laws and/or Easy Pay’s internal policies.

8. SERVICE FEE AND FOREIGN EXCHANGE RATES

8.1 There will be Service Fee on each transaction. For every payment order through the Website, the Customer shall be charged a service fee.

8.2 Easy Pay rights to determine Service Fee and Foreign Exchange rate. The Customer agrees that Easy Pay shall have the obsolete and sole discretion in determination of the Service Fee and Foreign Exchange Rate. The latest Service Fee and Foreign Exchange rate shall be applicable after being published on the Website.

9. PROHIBITIONS AND RESTRICTIONS

9.1 Prohibitions and restrictions in relation to the Services. Without prejudice to your rights in relation to any order for Services in relation to which we issued a confirmation, we reserve the right, at any time, to terminate or suspend your access to the Service without prior notice if:
a) You use the Service in any way which deprive other Company of their legitimate right to use the Service.
b) You use the Service or attempt to use it for any unlawful or prohibited purpose in breach of any Applicable Laws.
c) You attempt to transfer or charge funds from an account that does not belong to you.
d) We receive conflicting claims regarding ownership of the right to withdraw funds
e) You fail to provide us with true and accurate, current and complete evidence of your identity or details regarding transactions
f) You attempt to tamper, hack, modify, overload or otherwise corrupt or circumvent the security and/or functionality of the Website to infect it with any Malicious Code.
g) You copy, modify, reproduce, display, transmit, publish, post, transfer or sell any information, designs, logo, trademarks, software or services obtained from the Website.
h) You use the Service in a manner for self-promote purpose
i) You are in breach of the Terms and Conditions
j) Compliance Officer has taken a discretionary decision to do so.
k) We have reason to believe that any of the foregoing has occurred or is likely to occur

9.2 Do not breach the Applicable Laws. The Company shall comply and shall not breach the Applicable Laws, without limitation laws of such jurisdiction relating to the use of the Services.

10. PASSWORD

10.1 How to retrieve your lost password. If the Customer has forgotten the dedicated password to access the website, the Customer:
a) Shall access to the Log in page the website and click on “Forgot Your Password”. The Website will require Authorized Person to key in email address for verification purpose in order to receive an email link to reset password.
b) Acknowledges and agree that the Customer’s Authorized Person will be subject to identify verification to Easy Pay’s satisfaction. Easy Pay will provide an email link to reset password which will be communicated to the Authorized Person’s designated email address registered with Easy Pay Transfers. It is the Company’s responsibility to ensure that the Authorized Person maintain the email address.

10.2 The Company is responsible for Authorized Person’ password. The Company shall be fully responsible for all actions or omissions of the Authorized Person.

10.3 Contact us if you suspect your account has been compromised. If you suspect your Easy Pay Transfers account are stolen, lost or used without your authorization or compromised, you must contact us immediately. You are advised to change your password. Any undue delay in reporting to us may affect the security of your Easy Pay Transfers account and you are responsible for the financial losses.

11. MAINTAINING EASY PAY TRANSFERS ACCOUNT

11.1 No sign up fee with Easy Pay Transfers account. There is no sign up fee when you open an account with Easy Pay Transfers.

11.2 Your recent transactions are recorded on your Easy Pay Transfers account. All of transactions are displayed in the dashboard of your Easy Pay Transfers account. You may access this information after you have login into your Easy Pay Transfers account at the MYDASHBOARD Section. You can also download the transactions history at “Print e-Statement” at MYPAYMENTS section.

11.3 All transactions will have a reference number. A reference number will be allocated to every transaction. If you have any inquiries concerning a transaction status you made earlier, kindly quote the reference number when you communicate with us.

11.4 Do check your Easy Pay Transfers Account regularly. You are advised to check your Easy Pay Transfers account regularly and carefully. If you realized any unauthorized or incorrect executed transactions, please contact us immediately to assist you to rectify the transaction.

12. PERFORMING YOUR TRANSACTIONS

12.1 Your Easy Pay Transfers Account must be approved prior to making any transaction. In order to make a transaction with Easy Pay Transfers, your account and your Beneficiary must be verified and approved. It is important that you ensure the Beneficiary Account is accurate before making a payment order.

12.2 Payment orders are submitted online via your Easy Pay Transfers account. You must submit payment orders online with your Easy Pay Transfers account. To initiate a payment order, you must provide the necessary information and documents attached to us to proceed with your payments.

12.3 Execution of your Payment Order. We will only process your payment order once we have received the funds and the fees specified. It is your responsibility to make payment to us via FPX in a timely manner. We cannot be responsible for the time it takes for the money to be sent to us by your bank or payment service provider.

12.4 Confirmation email on your Payment Order. After you have make payment to us via FPX, an email notification will be sent to you acknowledging that your order has been received and it is under processing. Each payment order is given a reference number and is shown in the Dashboard on your Easy Pay Transfers Account.

12.5 Processing your Payment Order on the Business Day. It is important to note that your Payment Order shall only be processed on the Business Day. The Payment order will be subject to screening by our operation and Compliance Officer and may not necessary be accepted by Easy Pay.

12.6 Payment Receipt will be sent to your email address. After we process your transaction to the Beneficiary, a Payment Receipt shall be sent to your email address. For Dual Control features, please be informed that the Payment Receipt shall be sent to the Authorizer email address only.

13. CANCELLATION AND REFUNDS

13.1 You have the right to cancel a payment order before payment has been made via FPX to the Beneficiary. You can exercise this right by:
a) deleting the payment order at your Easy Pay Transfers account or
b) emailing us at support@easypaytransfers.com

13.2 You may exercise your right to cancel the payment order after you have already make the payment via FPX. You can exercise this right by emailing us at support@easypaytransfers.com. However, we will only be able to refund the money paid by you under the condition that it has not been paid to the Beneficiary in accordance with your original instruction prior to the cancellation request. The cancellation of the payment amount shall be the principal amount only and we reserve the right to retain the Fees charged for the Service and may charge you with an additional cancellation fees.

13.3 Transaction Cancellation or Refund. In the event the Customer cancels a transaction or the transaction is unsuccessful due to reasons of mistaken particulars by the Customer, the Customer shall remain liable for the Service Charge and Taxes. The principal amount shall be refunded to the same bank and account number received from the Customer.

14. CLOSING YOUR EASY PAY TRANSFERS ACCOUNT

14.1 You may close your Easy Pay Transfers Account at any time. You may request to close your Easy Pay Transfers account at any time by writing to us. Our contact details are provided on the “Contact Us” of our Website.

14.2 You must not close your Easy Pay Transfers Account to void an investigation. You must not close your Easy Pay Transfers account to evade an investigation by any third party. If you attempt to close your Easy Pay Transfers Account during an investigation, it may freeze the account to protect all parties to Easy Pay Transfers services and its affiliates or third party against any liability until the investigation is fully completed.

14.3 You are responsible for your Easy Pay Transfers Account after closure. You agree that you will continue to be responsible for all obligations related to your Easy Pay Transfers Account even after it is closed.

15. INTELLECTUAL PROPERTY

15.1 Intellectual Property. The Website and all intellectual property rights contained herein, including but not limited to any content, are owned or licensed by us. Intellectual property rights means rights such as logos, signs, email address, contents, domain names, design rights, copyright, database rights, trademarks, patents or all other intellectual property rights of any kind whether or not they registered or unregistered (anywhere in the world).

15.2 Prohibitions and Restrictions on Easy Pay Transfers’s Intellectual Property. Easy Pay Transfers materials including any software, contents, data, materials, electronic documentation developed and provided by us or our affiliates to you for download from our Website. You may not and may not attempt to, directly or indirectly:
a) copy, modify, imitate or tamper any software included in the Easy Pay Transfers materials
b) sell, rent, lease, distribute, transfer, sublicense, grant rights in the Service or Easy Pay Transfers to any person or entity.
c) remove, tamper or modify any notice of our trademarks, or other “intellectual property” appearing on or contained within the Services or any Easy Pay Transfers materials.
d) reverse engineering, disengage, split, distribute, separate or decompile the Easy Pay Transfers materials or the Services and apply other procedures to derive the source code of any software included in Easy Pay Transfers materials or as part of the Services.

15.3 Easy Pay Transfers reserve all rights on Intellectual Property. We reserve all of our rights in any intellectual property on the Website.

16. LIABILITY

In respect of any Loss in connection with the User’s use of the Website or Services, under no circumstances shall Easy Pay be liable to the Customer, in connection with its use of the Website or the Services for any loss of business or profits, revenue or goodwill, or any indirect, consequential, special, exemplary or punitive losses or damages.

16.1 You are liable for breaking this Terms and Conditions or Applicable Laws. You shall indemnify Easy Pay against all loss, claims, cost or expense caused by your breach of this Terms and Conditions or Applicable Laws to your use of our Services.

17. INFORMATION SECURITY

17.1 You are responsible to configure your Information Technology, computer software, programs and platform. It is important that you configure your computer in order to access our Services. You are advised to use virus protection software for information security purpose.

17.2 You must not misuse our Services. You must not misuse our Services by using viruses, Trojans, words, logic bombs or other materials which are malicious or technological harmful. You must not attempt to gain unauthorized access to our Website, our servers, computers or databases. We will report any such breach to the relevant law enforcement authorities and will cooperate with the respective authorities by disclosing your identity to them. In such event of breach, your right to use our Website and/or our Services will be terminated immediately.

18. LINKING TO OUR WEBSITE

18.1 Third Party Websites linked with Easy Pay Transfers. The Website may contains links or references to other websites. The linkage to other website provided herein are merely for the convenience of Users of this Website and Easy Pay Transfers bears no responsibility for the content of such other websites and shall not held liable for any damages howsoever arising therefrom. The Users shall view any of the linked websites at their own risks.

19. WHEN WE CAN END THIS AGREEMENT OR SUSPEND OUR SERVICES

19.1 We may suspend and close your Easy Pay Transfers account without notice in certain circumstances. We may suspend or cease your Easy Pay Transfers account without notifying you if:
a) You breach any provision of this Terms and Conditions
b) We are requested or directed to do so by any competent court of law, government authority, public agency or law enforcement agency
c) We have reason to believe you are in breach of any Applicable Law or regulation
d) We have reason to believe you are involved in any money launder activity, terrorism financing, fraudulent activity or other criminal activity.

19.2 We may suspend your Easy Pay Transfers Account for security reasons. We will suspend your Easy Pay Transfers account or restrict your use of Services if we have reasons about:
a) the security of your Easy Pay Transfers account
b) suspected fraudulent activity use of your Easy Pay Transfers account

19.3 We will give you notice of suspension where possible. We will notify of any suspension or restriction and the reasons for such suspension or restriction as soon as we can, unless notifying you would compromise our reasonable security measures. We will lift the suspension and/or restriction as soon as practicable after the reasons for the suspension and/or restriction have ceased to exist.

20. OUR RIGHT TO MAKE CHANGES

20.1 We reserve the rights to make changes on this Terms and Conditions. Easy Pay Transfers reserves the rights to change, vary or modify any of the information and terms contained herein from time to time without notice to you and post them on the Website. User’s continued use of the Services offered by Easy Pay Transfers after such variation, alteration and amendments have been posted constitutes User’s agreement to be bound by them.

21. HOW WE MAY CONTACT YOU

21.1 We usually contact you via email. For this purpose, it is important that you must maintain a valid email address at all times in your Easy Pay Transfers account. You are advised to check for incoming emails frequently as our emails may contain further communications or updates on our Websites. If you do not maintain or check your email and other methods of communications, you may miss emails about your transactions and our Services. At such, we cannot be liable for any consequences or loss as the result of it.

21.2 Other method that we may contact you. In addition to communication channels, we may also contact you via telephone where appropriate. If you use a mobile services, we may also communicate with you via telephone call, video call or SMS.

21.3 Our response to your emails or messages. If we receive emails from you on the same day before 5pm on the Business Day, we will always try to respond to your emails within two (2) working days. If we receives emails from you after 5pm on a Business Day or any other time, we shall respond to your emails on the next within two (2) working days.

22. COMPLAINTS

22.1 Your feedbacks and complaints are valuable to us. If you have any feedbacks or complaints about us or our Customer Services, you may contact us by writing to us. Our contact details are provided on the “Contact Us” of our Website.

23. OTHER IMPORTANT TERMS

23.1 This Terms and Conditions is between you and us. Nobody else has any rights under this Terms and Conditions. No other person shall have any rights to enforce any of its Terms and Conditions.

23.2 If a court or relevant authority finds part of this Agreement illegal, the rest will continue in force. Each of the sections of paragraphs of this Terms and Conditions operates separately. If any court or any relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

23.3 Even if we delay in enforcing this Agreement, we can still enforce later. If we delay in asking you to take certain actions, it will not prevent us taking steps against you at a later date.

23.4 This Terms and Conditions supersedes any other previous agreements. This Terms and Conditions will always supersedes all previous Terms and Conditions between you and Easy Pay Transfers, whether it is oral, written relating its subject matter.

23.5 Governing law. This Terms and Conditions will be governed by Malaysian law and the parties submit to the exclusive jurisdiction of Malaysia Courts.
